TERMS OF SERVICE
1. Acceptance of Terms:
By accessing and using the "BEST OF TIMES" Voting System (the "Voting System"), you agree to comply with and be bound by the following Terms of Service. If you do not agree to these terms, please do not use the Voting System.
2. Eligibility:
Users must be at least 18 years old to participate in voting.
Each user is allowed to submit up to three(3) votes per category. Multiple votes in a single category helps us provide a more accurate accounting and it gives you, the voter, the ability to vote for your top 3 favorites rather than limiting it to only one.
Users must reside in or have a valid connection to the city of Folsom, California.
3. Voting Process:
Voting in the Best of Times 2025 starts on May 20, 2025 and ends on June 27, 2025.
Votes must be submitted electronically through the Voting System platform.
Voters that violate the rules or attempt to use AI or any type of BOT to auto submit votes will be removed, accounts will be banned, and those votes will not be counted.
4. Account Registration:
Users may be required to create an account to participate in voting.
Users are responsible for maintaining the confidentiality of their account information.
Any unauthorized use of a user’s account should be reported immediately.
5. Prohibited Activities:
Users are prohibited from engaging in any activity that could interfere with the proper functioning of the Voting System, including but not limited to hacking, submitting fraudulent votes, or using automated systems to submit votes.
Users must not attempt to manipulate the outcome of the voting in any manner, including through the use of incentives or coercion. Businesses that engage with in this type of fraudulent activity will be banned from our directory and future contests.
6. Privacy Policy:
Any personal information collected through the Voting System will be used solely for the purposes of administering the voting process.
WE WILL NOT SELL, SHARE, OR DISTRIBUTE YOUR PERSONAL INFORMATION TO THIRD PARTIES WITHOUT YOUR CONSENT, EXCEPT AS REQUIRED BY LAW.
7. Intellectual Property:
All content, including text, graphics, logos, and images, on the Voting System is the property of All Town Media, LLC and is protected by intellectual property laws.
8. Liability Limitation:
The Voting System administrators are not liable for any damages, losses, or injuries arising from the use or inability to use the Voting System.
The Voting System administrators are not responsible for technical issues, including, but not limited to, lost, delayed, misdirected, or corrupted votes.
9. Dispute Resolution:
Any disputes arising out of or relating to the Voting System shall be resolved through negotiation between the parties. If the dispute cannot be resolved through negotiation, it shall be submitted to mediation.
10. Modification of Terms:
The Voting System administrators reserve the right to modify these Terms of Service at any time. Any changes will be posted on the Voting System website, and continued use of the system constitutes acceptance of the new terms.
RULES
1. Voting Categories:
Users can vote for businesses in various categories such as Best Restaurant, Best Retail Store, Best Service Provider, etc. Categories will be clearly defined on the Voting System platform.
2. Voting Frequency:
Each user is allowed to cast up to three votes per category during the voting period. Users found to be submitting multiple votes for the same business in a single category may have their votes disqualified.
3. Voting Criteria:
Users are encouraged to vote based on their personal experiences with the businesses. Factors such as quality of service, product offerings, customer satisfaction, and community impact should be considered.
4. Business Eligibility:
Only businesses operating in and around the city limits of Folsom, California, are eligible to be nominated and voted for in the Voting System.
5. Nomination Process:
Before the voting period, a nomination phase may be held where users can nominate their favorite businesses in each category.
The top-nominated businesses will appear on the final voting ballot.
6. Voting Integrity:
The Voting System is designed to be fair and transparent. Any attempts to manipulate the voting process, including but not limited to vote rigging, or use of automated voting tools, are strictly prohibited.
7. Result Announcement:
The results of the voting will be announced within a specified time after the voting period ends. The winners will be recognized on the Voting System website and may receive certificates or awards.
8. Appeals:
Businesses or users who believe there has been a mistake or unfair treatment during the voting process may file an appeal. Appeals must be submitted in writing within 7 days of the results being announced.
9. Code of Conduct:
All users and businesses participating in the Voting System are expected to adhere to a code of conduct that promotes respect, fairness, and integrity.
10. Enforcement of Rules:
Violations of the rules may result in disqualification of votes, removal from the Voting System, or other actions as deemed appropriate by the administrators.
